Terms of Service

The short version
- By creating an account or using Muznly, your business agrees to these terms.
- You pay per branch per month in UAE dirhams, plus 5% VAT. You can cancel at any time, effective at the end of your billing period.
- Your data is yours. You can download all of it, even after you cancel.
- Muznly is provided âas isâ. You are responsible for how you use it, your prices, your records and your tax compliance.
- As far as UAE law allows, our liability is limited to the fees you paid us in the 3 months before a claim.
Who we are
Muznly makes point-of-sale software for restaurants and cafĂ©s: a till app for Windows and Android tablets (iPad coming soon), a web back office and a driver app (together, âthe serviceâ). We are based in Dubai, United Arab Emirates.
In these terms, âweâ, âusâ and âourâ mean Muznly. âYouâ and âyourâ mean the restaurant, cafĂ© or other business that uses the service, including anyone who uses it on the business's behalf.
These terms cover using Muznly and paying for it. Our Terms & Conditions cover our website and the Founding Restaurant programme, and our Privacy Policy explains how we handle personal data.
Accepting these terms
By ticking the box to accept these terms, creating an account or using the service, you agree to these terms. If you don't agree, don't use the service.
If you accept on behalf of a business, you confirm that you are allowed to bind that business to these terms. The business is then bound by them.
You must be at least 18 to accept these terms.
Your account and security
Give us accurate information when you sign up, and keep it up to date.
Keep your sign-in details safe: passwords, passkeys, two-step sign-in devices and staff till codes. Don't share them. We recommend turning on two-step sign-in.
You are responsible for everything done under your account, including by your staff and by anyone who uses your account's sign-in details or till codes.
You decide who gets access and what each person can do. Give staff only the permissions they need, and remove access promptly when someone leaves.
If you think someone has used your account without permission, change your sign-in details and tell us at once at hello@muznly.com.
Subscriptions, billing and VAT
Muznly is a subscription. You pay per branch per month, plus a monthly fee for each extra till. Prices are in UAE dirhams (AED), and VAT (currently 5%) is added on top.
Fees are due for each billing period as shown on your invoice. If a payment isn't made, we may suspend your account until it is (see âSuspension and terminationâ).
Our current prices are introductory and may change. If we change the price you pay, we will tell you at least 30 days before the new price takes effect. If you don't agree, you can cancel before then.
Our current prices are introductory starting prices. They are not final and may change after launch, for founding restaurants too, with the notice above. See our Terms & Conditions.
Cancelling
You can cancel at any time. Your cancellation takes effect at the end of your current billing period, and you can keep using the service until then.
We don't refund partial billing periods, unless the law requires us to.
After you cancel, you can still download your data for a limited time. See âYour dataâ.
Your data
Everything your business puts into Muznly (menus, prices, orders, sales, customers, staff and so on) belongs to you.
You give us permission to store, copy and process your data only as needed to run, secure and support the service for you, and as the law requires. We don't sell it.
You can download all your data at any time as spreadsheets (CSV files in a ZIP), including after you cancel. We keep your data for a limited time after cancellation so you can download it, then we delete it, except records we must keep for as long as the law requires.
You are responsible for your data: that it is accurate, that you have the right to put it into Muznly, and that you collect and use your customers' and staff's personal data lawfully. For that personal data, you are the controller and we process it on your behalf, as explained in our Privacy Policy.
Keep your own copies of important records, and download your data regularly.
Acceptable use
While your subscription is active and you follow these terms, we give you a limited, non-exclusive, non-transferable right to use the service for your own business. We keep all rights in the service itself.
You must not, and must not let anyone else:
- use the service for anything illegal or fraudulent
- create false, misleading or fake tax invoices or records, or use the service to evade tax
- copy, modify, decompile or reverse engineer the service, or try to get its source code, except where the law expressly allows it
- resell, rent, sublicense or otherwise give the service to others, or use it to build a competing product
- attack, overload or disrupt the service, try to get around its security, or try to access other customers' data
- upload viruses or other harmful code
- use the service in a way that infringes anyone else's rights
Availability and changes to the service
We work to keep Muznly running well, but we don't promise it will always be available, uninterrupted or free of errors. We don't offer an uptime guarantee or a service level agreement.
Muznly needs an internet connection today. Offline mode, delivery-app connections and card-terminal connections are coming soon; until they are released, they are plans, not promises.
We may need to pause the service for maintenance, updates or security. Where we can, we will do this at quiet times and let you know in advance.
We may change, add or remove features as Muznly develops. Where reasonable, we will tell you about important changes in advance.
Support access
Our support team can see your business data only if you grant access from your account. You choose for how long, from 1 to 168 hours. Access is read-only unless you allow more, every action is logged under the support person's name, and you can revoke access at any time.
If you allow us to make changes, we will act on your instructions, but you remain responsible for checking the result.
Suspension and termination
We may suspend or close your account if:
- you don't pay fees when they are due
- you break these terms or the law
- your use puts the service, other customers or us at risk
- the law or an authority requires us to
Where reasonable, we will warn you first and give you a chance to fix the problem. If the risk is serious or urgent, we may act straight away.
If we decide to stop providing the service to you for any other reason, we will give you reasonable notice so you can download your data.
When your account ends, your right to use the service ends. You can still download your data for a limited time, as explained in âYour dataâ. Any fees you owe, and the sections on disclaimers, liability, indemnity and disputes, continue to apply.
Disclaimers
To the maximum extent permitted by law, the service is provided âas isâ and âas availableâ. We give no promises or warranties, express or implied, that it will be uninterrupted, timely, secure or error-free, that it will meet your needs or fit a particular purpose, or that reports and calculations will be free of mistakes.
You are responsible for:
- how you and your staff use Muznly
- who you give access to, and what permissions they have
- your prices, menus and discounts, and the details on your receipts and invoices
- your tax registration, VAT returns and compliance with the law. Muznly helps you produce VAT invoices, but it is not tax or legal advice, and you remain responsible for your own tax compliance
- checking your reports, cash counts and stock figures
- keeping your own records and copies of your data
- your devices, internet connection, printers and other hardware
Limitation of liability
This section limits what we are responsible for. Please read it carefully.
To the maximum extent permitted by law, Muznly is not liable for any:
- indirect, special or consequential loss
- lost sales, lost profits or lost revenue
- loss of business, contracts, opportunities or goodwill
- business interruption
- insolvency or bankruptcy
- loss or corruption of data
- loss caused by misuse of the service by you, your staff or anyone using your account
- loss caused by failures of the internet, your devices or other hardware, third-party services, or events outside our reasonable control
This applies however the loss arises, whether under contract, for a harmful act (including negligence) or otherwise, and even if we were told the loss was possible.
To the maximum extent permitted by law, our total liability to you for all claims of any kind is limited to the fees you paid us in the 3 months before the event that caused the claim (which is zero if you haven't paid us anything).
Nothing in these terms limits or excludes any liability that cannot be limited or excluded under UAE law, such as liability for fraud or intentional harm.
Your responsibility for claims
You will cover Muznly against all claims, losses, fines, damages and costs (including reasonable legal fees) that arise from: misuse of the service by you, your staff or anyone using your account; your breach of these terms or of the law; or your data, including personal data you put into Muznly.
Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control (force majeure), such as power or internet outages, failures of hosting or other providers, cyber-attacks, natural disasters, epidemics, war, unrest, strikes or government action. Our obligations are paused for as long as the event lasts.
Changes to these terms
We may update these terms. When we do, we will post the new version here with a new date. If a change is important, we will also tell you by email.
If you keep using the service after the new terms take effect, you accept them. If you don't agree, you can cancel.
Governing law and disputes
These terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates.
If you have a problem, please email us first at hello@muznly.com. We will both try in good faith to settle it within 30 days.
If we can't settle it, the courts of Dubai have exclusive jurisdiction.
General
- If any part of these terms can't be enforced, the rest still applies.
- If we don't enforce a right straight away, we haven't given it up.
- We may send you notices by email to the address on your account.
- These terms are published in English and Arabic. If the two differ, the English version applies, as far as the law allows.
